A significant legal challenge has emerged in Quetta, Pakistan, as a public interest petition has been filed in the Federal Constitutional Court (FCC) to halt the construction of a flyover on land allegedly belonging to the Balochistan Institute of Nephrology (BIN), also referred to as the Balochistan Institute of Nephro-Urology (Binuq) in different reports. This petition, the first of its kind following the 27th Constitutional Amendment, was submitted under Article 175A(3) by Advocate Taqweem Shah through senior lawyer Hafiz Ihsan Khokhar. According to Business Recorder, the petition argues that the flyover's construction violates constitutional property rights under Articles 23 and 24, as it is being built without lawful acquisition or compensation as per the Land Acquisition Act, 1894. The Tribune Latest corroborates these claims, emphasizing the disruption caused to the hospital's operations, which is the only specialized kidney treatment facility in the province, serving patients from Quetta and remote districts. The construction has reportedly impeded ambulance access and emergency services, posing 'serious risks to patients.'
